A lease is a rental agreement, usually in writing, between the owner of a property and a tenant who wishes to have temporary ownership of the property; it is different from a lease agreement which is rather for a fixed term. The agreement fixes at least the parties, the property, the duration of the lease and the amount of rent for the duration. The owner of the property can be designated as the owner and the tenant as the tenant. At the beginning of the lease, you can ask a tenant to pay the last month`s rent in advance and a deposit not exceeding the equivalent of one month`s rent. Clearer rules regarding the termination of a lease or the resolution of a dispute. Italian rental contracts for real estate are not clearly governed by the written agreement between the owner and the tenant. Italian civil law requires a correspondence between the destination of the use (e.g.B. the residential, commercial activity) agreed by the contracting parties and the place of actual use that the tenant has accepted after its advertising for the property. In the event of a relevant difference, the owner has the possibility to terminate the contract due to a serious non-performance. An after-lust rental agreement allows you to move for 30 days after proper written notice. It also allows the landlord to ask you to leave or increase your rent with 30 days` written notice.
The winning applicant for a leased property is usually asked by the broker or lessor to sign a lease agreement, also known as a residential lease agreement, before they can move in. Property owners can ask for references and proof of income to verify tenants. Once everything is finished, the owners offer you either a lease or a lease after authorization. A lease by agreement offers more flexibility, but a lease offers more security. In addition to those mentioned above, a car rental agreement may contain different restrictions on how a renter can use a car and the condition in which it should be returned. For example, some rentals cannot be driven on the ground or outside the country without express permission or a trailer can be discarded. In New Zealand, you may have to keep an express promise that the car will not be driven on Ninety-Mile beach (due to dangerous tides). Additional conditions may be included and the agreement must comply with the Residential Tenancies Act 1997.
If he does not practice the express option, defined by law or by the treaty, the contract remains in force and the civil court is legally entitled to assess the actual use of the property as well as the implicit conscience and tolerance of the owner (in the absence of measures of solution in relation to the contract). Suddenly, the judge has the right to determine the new contractual agreement and reconcile its terms with the actual purpose of the use of the property. . . .
